Terms of Service

digitaldawn.ai (“we”, “us”, “Dawn”) provides an AI-powered lead response and client management platform to small businesses (“you”, “Client”). By signing up or using our platform you agree to these Terms.

We provide:

• AI-generated responses to inbound leads using Claude (Anthropic)
• Automated follow-up email sequences
• A client portal for reviewing leads, approving AI responses, and managing settings
• Optional add-ons including custom sending domains

Service features vary by plan tier. We may update or modify features with reasonable notice.

Each subscription covers one business. You are responsible for keeping your login credentials secure. You may add additional portal users within the limits of your plan. All users under your account are bound by these Terms.

You agree to use the platform only for lawful business purposes. You must not:

• Use the platform to send unsolicited bulk email (spam)
• Submit false or misleading information about your business
• Attempt to access another client's data or portal
• Reverse engineer, scrape, or abuse our APIs
• Use AI-generated content in ways that violate applicable law or third-party rights

Responses generated by our AI are produced automatically based on your configuration and the lead's submitted information. You are responsible for reviewing AI responses before they are sent (where approval mode is enabled) and for any content sent from your account.

AI responses may occasionally be inaccurate, incomplete, or inappropriate. We are not liable for outcomes arising from AI-generated content.

When a lead submits their information through your intake form, that data is processed on your behalf. You are responsible for:

• Having a lawful basis to collect and process your leads' personal information
• Disclosing to leads that their information will be processed by AI tools
• Complying with applicable privacy laws in your jurisdiction (e.g. CAN-SPAM, CCPA, GDPR)

We act as a data processor on your behalf for lead data. See our Privacy Policy for details on how we handle this data.

Subscriptions are billed monthly. We offer a free trial period for new clients as communicated at signup. After the trial ends, your plan renews automatically unless cancelled. All fees are in USD unless otherwise stated.

We provide a 30-day money-back guarantee on your first paid month if you are not satisfied. After that, fees are non-refundable.

We make reasonable efforts to keep the platform available and reliable. We do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible. We are not liable for losses caused by downtime or service interruptions.

Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your account immediately for material breaches of these Terms.

After termination you will have 30 days to export your data. After that window, we may delete your data in accordance with our retention policy.

To the fullest extent permitted by law, digitaldawn.ai's total liability for any claim arising from your use of the platform is limited to the fees you paid in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Kentucky, United States, without regard to its conflict of law provisions. Any disputes will be resolved in the courts of Kentucky.
